1. Scope of application

These terms & conditions apply to all deliveries from Mihoko Kimura, edition offenburg, Sommerhalde 15, 77656 Offenburg, Germany, to consumers (§ 13 BGB) and contractors (§ 14 BGB). The specific arrangements for contractors are marked accordingly.

2. Party to the agreement

3. Offer and conclusion of the contract

3.1 The presentation of products in our online shop does not constitute a legally binding offer, but a call for order. Errors expected.

3.2 By clicking the button "Place Order" you place a binding order for the products listed on the order page. The purchase contract is concluded when we accept your order with an order confirmation via e-mail immediately after receiving your order.

3.3 The contract text is stored on our internal systems. The order information and the terms & conditions shall be sent to the e-mail address specified by you after the conclusion of the contract.

4. Right of revocation

4.1 Consumers have a fourteen-day right of revocation.

You have the right to revoke your contractual statement within 2 weeks, without stating reasons, either in writing (e.g. letter, e-mail, fax) or, if the goods are dispatched to the customer within the revocation period, also by returning them. The revocation period begins after receipt of these instructions in written form, but not before receipt of goods by the customer (for repeat deliveries of similar goods, not before receipt of the first partial delivery) and not before we have fulfilled our obligation to instruct pursuant to article 246 § 2 in connection with § 1 (1) and (2) EGBGB as well as our obligations pursuant to §312g (1) (1) BGB in connection with article 246 § 3 EGBGB. In order to observe the revocation period, you must give notice of revocation, or return the goods, within the revocation period. Please address notice of revocation to:

Consequences of Revocation

In the case of valid revocation, all considerations received by either party and, where applicable, any utilization (such as interest) shall be returned. If you are unable to return the goods/services provided in full or in part, or only in an impaired state, you may be required to provide compensation for the loss in value. You must only pay compensation for the deterioration of the goods and the benefits obtained insofar as the benefits or the deterioration are due to a handling of the goods that goes beyond testing the characteristics and the functionalities. "Testing the characteristics and the functionalities" means to test and try out the respective goods as is possible and customary in a shop, for example. Goods that can be returned as packages must be returned at our risk. You are responsible for covering the regular cost of return postage if the goods delivered are as ordered and if the price of the goods to be returned is less than € 40, or in case of a higher price you have not provided consideration or a partial payment agreed under the terms of the contract. Return mail is otherwise free of charge. Goods that cannot be returned as packages will be picked up from your address. Obligations to refund payments must be fulfilled within 30 days. This period commences for you when you issue notice of revocation, or dispatch the goods, and for us on their receipt.

End of revocation instructions

4.2 If you are a contractor according to § 14 BGB and and act at the conclusion of the contract in the course of your trade or profession, there is no right of revocation.

4.3 When exercising your right of revocation (see revocation instructions), you are responsible for covering the cost of return postage if the goods delivered are as ordered and if the price of the goods to be returned is less than € 40, or in case of a higher price you have not provided consideration or a partial payment agreed under the terms of the contract. Return mail is otherwise free of charge.

5. Prices and shipping costs

5.1 The prices stated on the product pages include VAT and other price components.

5.2 We charge shipping costs for shipping and handling in addition to the stated prices. The shipping costs will be clearly indicated in our shopping cart system. For a breakdown of our shipping costs, see www.edition-offenburg.com/lieferung/.

6. Delivery

6.1 We ship via DHL, Hermes, or Deutsche Post.

6.2 The delivery period for shipments to Germany is about 2 to 4 days, for shipments to Europe 2 to 4 days, for shipments to all other countries 4 to 6 days by air mail and 10 to 30 days by ground shipping. Possibly differing delivery times are indicated on the respective product page.

7. Payment

7.1 Payment is either via PayPal, against advance payment or on account.

7.2 If you choose advance payment, we will provide our bank details in the confirmation of order and deliver the goods after receipt of payment.

7.3 Delivery on account is for merchants, schools and public agencies only.

7.4 A right of set-off is available only if your titles are legally established in court or are undisputed or acknowledged by us in writing.

7.5 You can only exercise a right of retention if the titles result from the same contractual relationship.

8. Retention of title

The goods remain our property until full payment.
