Applicability and validity of the terms and conditions
In our General Terms and Conditions, the following terms shall have the following meanings

- Customer: any natural person or legal entity that enters into an agreement with Golden River Music;
- Website: the website managed by Golden River Music: www.goldenrivermusic.eu
These terms and conditions apply to all offers on the Golden River Music website, as well as all agreements entered into with Golden River Music via the website.
By using the website and placing an order, the customer accepts all our general terms and conditions, as well as all other rights and obligations as stated on the website.
General terms and conditions applied by the customer are not binding without an explicit and written agreement to this effect. If certain deviating conditions are agreed, the other provisions in these terms and conditions remain in full force.
Golden River Music is entitled to call on third parties in the execution of an agreement with the customer. Golden River Music reserves the right to change and/or supplement these General Terms and Conditions at any time for future orders.
Offers and quotations
All offers and quotations are without obligation, unless a term for acceptance is included therein. If a quotation contains a non-binding offer, we reserve the right to revoke it within two (2) days of receipt.
A quotation made in writing is valid for two (2) weeks, unless a different term is stated on the quotation.
An agreement is concluded at the moment that the customer has accepted the offer and the General Terms and Conditions and that an order confirmation has been delivered to the customer by Golden River Music, either in writing or by email to the email address provided by the customer.
The customer and Golden River Music agree that the use of electronic forms of communication constitutes a valid agreement. The absence of a normal signature does not affect the binding force of the acceptance of the offer.
The agreement and the General Terms and Conditions remain in force until all obligations have been fulfilled.
Golden River Music endeavours to display the current stock status of all items on the Website as accurately as possible. If products ordered are not in stock, despite the indication on the Website, the customer will be informed accordingly.
Golden River Music reserves the right to refuse an order without giving reasons.
Prices
All prices are expressed in euros. These are exclusive of VAT during the offer. The prices of the products are those stated on the website at the time the customer places an order. In the order overview and the invoice, the customer will be informed of all prices including costs and taxes at the rate applicable in the country where the customer resides.
Obvious errors such as evident inaccuracies may be corrected by Golden River Music, even after the agreement has been concluded.
Discounts, where applicable, are granted per agreement and do not automatically entitle the customer to the same discount in a subsequent agreement.
Payment
Payment for orders placed via the Website will be received via PayPal, American Express, Visa and Mastercard, Bancontact/Mister Cash and IDEAL 2.0. The customer must make the payment upon receipt of the invoice so that the order can be shipped. Costs related to the payment are for Golden River Music.
Payments for orders placed by email, telephone or fax can be received by bank transfer.
The customer must make the payment within thirty days of receiving the invoice to the account of Golden River Music, ING: 385-0700160-77, IBAN: BE80 3850 7001 6077, BIC: BBRUBEBB. Costs related to the payment are for the customer.
Costs related to the order and shipping are borne by the customer.
Golden River Music may expand the payment options in the future. These will be announced on the Website.
If Golden River Music has agreed to a payment term, the customer is in default if this term is exceeded.
In the event of non-payment or late payment by the customer, the customer shall owe interest on the outstanding amount at the statutory interest rate, calculated from the date on which payment should have been made at the latest until the date of full payment.
The customer shall also be liable for any (extra)judicial costs of any nature whatsoever incurred by Golden River Music as a result of the customer’s failure to fulfil its payment obligation.
In the event of late payment, Golden River Music is entitled to suspend all further deliveries until the customer has fully complied with its payment obligation, including the interest and/or costs owed.
Shipping and delivery
The company shall deliver the products as described in the product description on the Website, including the quality and characteristics specified in the product description. The customer shall not be provided with a more recent version of the product than the version included in the product description on the website.
During the ordering process, the customer can choose from the shipping methods offered by the company: digital delivery and/or printed (paper) delivery.
If the customer opts for digital delivery, they will receive an E-score, which they can download immediately after purchase.
If the customer was registered and logged in before the purchase, the E-scores will remain available in their account and in the confirmation email they receive. More information about our E-scores can be found under “E-scores” in the menu on the home page of the website.
These E-scores cannot be returned.
Printed orders are delivered by Bpost.
The customer can collect the Products by appointment at the company’s premises.
If the products are delivered to the customer’s home, they will be delivered to the address provided by the customer to the company during the ordering process. Upon dispatch, the customer will receive an email with the date of dispatch.
If no one is available at the customer’s address at the time of delivery, the customer must follow the instructions of the delivery service responsible for delivering the order.
The company undertakes to deliver the products within one month of full receipt of payment, unless another delivery date is agreed between the company and the customer at the time the agreement is concluded.
If the company is unable to deliver the products within the above-mentioned period, the company undertakes to inform the customer in writing and to agree on a new, reasonable delivery period. If the company again exceeds the deadline, the customer has the right to cancel the order.
The company reserves the right to make partial deliveries of the products ordered, for example if part of the order is delayed or unavailable. In the event of partial delivery, the company will inform the customer by email.
Upon delivery/collection, the customer must check the packaging for any damage. If the products are damaged, the Customer may not accept the delivery and must immediately notify the company by email or telephone. After notification, the company will provide the customer with the necessary instructions regarding the damaged products.
Shipping
For shipments by post, the rates of Bpost + 1.6 euro will be charged as a contribution to the delivery and administration costs.
The prices of postage depend on the weight of the order and the customer’s address.

Right to cancel an order before delivery
The customer has the right to cancel the analogue (paper) order without giving any reason and without incurring any costs before the order is dispatched.
The customer can only cancel the order by email or telephone.
After cancellation of the order, the customer will receive confirmation of the cancellation by email and the company will refund the amounts already paid to the credit card or debit card used by the customer to pay.
If the customer has received confirmation that the product has been shipped to the address provided, the customer can no longer cancel the order.
If it was not possible to cancel the order, the product will be delivered and the customer can return it in accordance with the procedure described in the following article.
The company has the right to cancel the order if Bpost is unable to deliver to the address provided by the customer.
Return of goods – right of withdrawal – refund
The ‘distance selling’ law provides for the right to cancel the sale within a period of 14 calendar days after purchase, starting from the day after delivery to the customer. The customer may therefore exercise their right of withdrawal. If several products are delivered to the customer on different days, the period starts on the day after the customer receives the last of the products ordered. If the product is delivered within a certain period, the period begins on the day after the day on which the customer received the first delivery of the products. The purchased product can be exchanged or returned complete and unused in its original undamaged packaging (as far as possible). Exceptions: The following items cannot be exchanged and/or returned:
- software, DVDs, CDs whose seal has been broken.
- music books, sheet music that clearly show signs of use/copying.
Returned products may only be unpacked or used by the customer to the extent necessary to determine the nature, characteristics and functioning of the product, as the customer would be allowed to do in a shop. The customer is liable for any loss in value resulting from further unpacking or use of the product.
- digital sheet music.
The costs of returning an item are borne by the customer. The items must be sent in equally sturdy packaging so that they arrive at Golden River Music undamaged. If the customer has paid a pro forma amount, Golden River Music will refund this amount as soon as possible, but no later than 30 days after the item has been returned, in the same manner as we received the payment. However, the company may reduce the refund to take into account any reduction in the value of the products if this was caused by the customer handling them in a way that would not be permitted in a shop.
The company has the right to refund the customer with vouchers if the customer used vouchers to pay for the products.
In the event of manufacturing defects or printing errors, the items will of course be replaced free of charge. To do so, simply contact us by email at info@goldenrivermusic.be or by telephone on 0032(0)52 22 11 87.
If Golden River Music has not provided the customer with the legally required information regarding the customer’s right of withdrawal, the customer will have twelve (12) months to withdraw from the contract from the day after the end of the aforementioned initial period of fourteen (14) days. If the company has provided the customer with the legally required information regarding the customer’s right of withdrawal within the aforementioned period of twelve (12) months, the customer will have fourteen (14) days to withdraw from the agreement from the day after the customer has received the information from the company.
Golden River Music can never be held liable for any damage, loss or theft to the products or packaging during return shipment.
Liability
If the goods delivered by Golden River Music are defective or prove to be faulty, they will be replaced or repaired free of charge by Golden River Music within the applicable warranty periods and conditions prescribed by Belgian law. Golden River Music shall become the owner of the replaced goods. In the event of force majeure, Golden River Music shall not be bound by any obligations towards the customer. Golden River Music may suspend its obligations for the duration of the force majeure.
Force majeure is understood to mean any circumstance that makes it impossible for Golden River Music to fulfil its obligations towards any other party, either in whole or in part. This includes, but is not limited to, strikes, fire, business interruption, power failure, telecommunications network failure, non-delivery or late delivery by suppliers or other third parties engaged by Golden River Music.
The customer must inform the company by email of the defect within two (2) months of the day on which the customer discovered the defect. After this period, the customer loses the right to invoke the warranty.
If a defect occurs within the warranty period, the customer must return the defective products to the company in their original packaging, without undue delay, and in any case no later than fourteen (14) days after sending the notification of the defect to the company. The products must be sent to the company in the same way as the customer received them.
All costs incurred by the customer for returning the products shall be reimbursed by the company within a reasonable period of time after receipt of the products and after determination of the defect, provided that the customer has used the designated standard shipping method to return the product.
After the defective product has been returned, the company will, at the customer’s discretion, repair the product or send a new product to the customer, and the company will bear all costs associated with the exchange/repair of the product. The product can only be replaced and delivered insofar as it is still available/in stock from the company’s suppliers. If the defect is serious or the repair or replacement is insufficient, impossible, not carried out within a reasonable period of time or would cause serious inconvenience to the customer, the company will grant an appropriate price reduction or, if the defect is not minor, allow the agreement to be terminated. Within a reasonable period after the company has been notified of the defect, it will attempt to bring the digital content or digital service into conformity. If the defect is serious or the digital content or digital service cannot be brought into conformity in time, is insufficient, impossible or would involve disproportionate costs for the company, the company shall grant an appropriate price reduction or, if the defect is not minor, allow the customer to terminate the contract. Refunds relating exclusively to digital content or digital services will be made within fourteen (14) days of the company being notified in good time by the customer of their decision to terminate the contract. After termination, the customer may no longer use the digital content or digital service or make it available to third parties.
The company is not liable for any defects in the products of which the customer was aware at the time of purchase.
The company does not guarantee that the products are suitable for the specific purposes for which the customer wishes to use them.
The company undertakes to carry out system and security updates for the products during the period in which the products are offered for sale.
The company does not offer any additional guarantees for the products with regard to quality, performance or other characteristics, durability, functionality, compatibility, accessibility, continuity, security/safety, updates, accessories and attachments that are not included in the product description on the website.
The company reserves the right to make minor changes to the product in order to continue to guarantee conformity or to improve the operation, security or functionality of the product for the customer.
Complaints procedure

Complaints must be submitted to Golden River Music in full and clearly described in the manner specified above within a reasonable time after the customer has discovered the defects. Complaints submitted will be answered within a period of 14 days from the date of receipt, unless the complaint requires a longer processing time due to the scope or complexity of the complaint(s) received by the company.
Transfer and subcontracting
The company has the right to transfer its rights and obligations under the Agreement to a supplier (e.g. for the delivery of the product), but this will not affect the rights and obligations under these general terms and conditions.
If the customer has purchased a product as a gift, they may transfer the warranty to the recipient of the gift without having to ask the company for permission.
Intellectual property
The customer explicitly acknowledges that all intellectual property rights to the information, communications or other expressions relating to the website are vested in Golden River Music, its suppliers or other entitled parties.
Intellectual property rights are understood to mean: patent, copyright, trademark, design and model rights and/or other rights, including technical and/or commercial know-how, methods and concepts, whether or not patentable.
Illegal copying and distribution is prohibited and punishable under criminal and civil law. The e-scores published by Golden River Music are personalised and secured with a digital watermark.
Privacy
Golden River Music complies with the applicable laws and regulations when processing customer data.
Golden River Music will under no circumstances sell or disclose the customer’s email address or pass on personal information to any third party, with the exception of third parties engaged for the delivery of ordered goods.
The company processes the customer’s personal data exclusively in accordance with the Privacy Policy on the website.
Dispute resolution and applicable law
All offers and agreements are governed exclusively by Belgian law.
All disputes relating to or arising from offers made by Golden River Music or agreements concluded with Golden River Music shall be submitted to the competent court in Dendermonde, unless a mandatory provision of law expressly designates another court as competent.
Miscellaneous provisions
The registered office of Golden River Music BV is located at 9200 Dendermonde, Korte Haagstraat 13, VAT-number: BE 0476 725 108. All correspondence relating to an agreement or these General Terms and Conditions can be addressed to Golden River Music at the above address or to the email address info@goldenrivermusic.be.
Without prejudice to the rights and remedies granted to the customer by applicable law or these General Terms and Conditions, our liability for direct damage shall be limited to the value of the products ordered.
If any provision of these General Terms and Conditions is unlawful, void or unenforceable for any reason, that provision shall be deemed severable from these General Terms and Conditions and shall not affect the validity and enforceability of the remaining provisions. These General Terms and Conditions constitute the entire agreement between the customer and Golden River Music with regard to the subject matter hereof.
